Terms of Service

1. About RateRadar and these terms

RateRadar is a rate intelligence service for hotels and hospitality businesses, operated by Watchtower Analytics Limited, registered in England and Wales (company number 16073370), registered office 236 Kingsley Road, Hounslow, Middlesex, United Kingdom.

The service provides competitor rate monitoring, pricing recommendations, booking pace analysis, and market intelligence reports. These terms govern your access to and use of RateRadar. Where we refer to “we”, “us”, or “our” we mean Watchtower Analytics Limited. Where we refer to “you” or “your” we mean the subscribing hotel, business, or individual.

2. Eligibility and account registration

RateRadar is intended for use by hotels and hospitality businesses. By signing up you confirm that:

• You are signing up on behalf of a hotel or hospitality business, or in your capacity as an individual working in the hospitality sector.
• You are at least 18 years of age.
• The information you provide at registration is accurate and complete.
• You will keep your login credentials secure and not share them with third parties.

We reserve the right to decline or terminate accounts at our discretion, including where use appears inconsistent with the hospitality sector purpose of the service.

3. Free trial

New subscribers receive a free trial period as stated on the pricing page at the time of sign-up. During the trial you have access to the full service. At the end of the trial period your subscription will convert to a paid plan and billing will begin unless you cancel before the trial ends. We will send a reminder before the trial expires.

4. Pricing and payment

RateRadar is available on the following plans:

• Current plan pricing and billing intervals are listed on the pricing page at the time of sign-up.
• The price that applied when you subscribed is confirmed in your account activation email.

All prices are inclusive of any applicable taxes. Watchtower Analytics Limited is not currently registered for VAT.

Payments are processed by Stripe. By subscribing you authorise us to charge your payment method on the billing frequency you select. Payments are taken in advance at the start of each billing period. If a payment fails we will notify you and attempt to retry. Access to the service may be suspended if payment cannot be collected after a reasonable retry period.

We reserve the right to change our pricing with 30 days’ notice. You will be notified by email before any price change takes effect and may cancel before the new price applies.

5. Cancellation

You may cancel your subscription at any time. Cancellations require one calendar month’s notice. Notice must be given by emailing info@watchtower-analytics.com with your account details.

During the notice period you retain full access to the service. We do not provide refunds for unused portions of a billing period except where required by applicable law.

We may also terminate your account immediately if you breach these terms, engage in fraudulent activity, or use the service in a way that causes harm to us or other users.

6. The service — what we provide and what we do not

RateRadar provides competitor rate data and pricing recommendations based on publicly available information gathered from online travel agencies and other public sources. By their nature, these are advisory and indicative rather than definitive.

You acknowledge that:

• Rate recommendations are generated algorithmically and should be used alongside your own market knowledge and commercial judgement. They are not a substitute for professional revenue management advice.
• Competitor data reflects publicly visible rates at the time of collection and may not reflect private rates, direct booking rates, or rates available through channels not monitored by the service.
• Data coverage depends on the availability of source data for your area. We do not guarantee coverage of all competitors or all dates.
• The service is provided over the internet and may be subject to downtime for maintenance or circumstances beyond our control.

7. Acceptable use

You agree not to:

• Use the service for any unlawful purpose or in any way that infringes the rights of others.
• Attempt to access, scrape, or extract data from the platform by automated means other than through any API we provide for that purpose.
• Resell, sublicense, or otherwise make the service available to third parties without our prior written consent.
• Use competitor rate data obtained through RateRadar in any way that violates applicable competition law.
• Attempt to reverse engineer or compromise the security or integrity of the platform.

8. Intellectual property

The RateRadar platform, including its software, design, algorithms, and compiled data outputs, is the intellectual property of Watchtower Analytics Limited. Your subscription gives you a personal, non-transferable licence to use the service for your own hotel’s rate management purposes.

You retain ownership of any data you provide to us (such as your hotel’s rate data uploaded via our PMS integration). You grant us a licence to use that data to provide the service to you.

9. Privacy and data

Our Privacy Policy explains how we collect, use, and protect personal data. By using RateRadar you agree to our Privacy Policy.

10. Liability

To the maximum extent permitted by applicable law:

• We provide the service “as is” and make no warranties, express or implied, regarding its fitness for a particular purpose, accuracy, or uninterrupted availability.
• We are not liable for any loss of revenue, loss of profit, loss of data, or any indirect or consequential loss arising from your use of or inability to use the service.
• Our total liability to you for any claim arising from these terms or your use of the service is limited to the fees you have paid to us in the 12 months preceding the claim.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

11. Governing law and disputes

These terms are governed by the law of England and Wales. Any dispute arising from these terms or your use of the service will be subject to the exclusive jurisdiction of the courts of England and Wales.

We will always attempt to resolve disputes informally in the first instance. Please contact us at info@watchtower-analytics.com before initiating any formal proceedings.

12. Changes to these terms

We may update these terms from time to time. We will give you at least 30 days’ notice of material changes by email. Continued use of the service after the effective date of updated terms constitutes your acceptance. If you do not agree to the updated terms you may cancel your subscription before they take effect.
